AIF workers’ comp fix would make employees pay their own attorney fees

in Statewide by

Associated Industries of Florida released its fix for rising workers’ compensation rates Tuesday. The lobby’s proposed legislation would make injured employees responsible for their own attorney fees. The draft bill stipulates that “a claimant is responsible for payment of her or his own attorney fees” for litigation arising from a claim. “A judge of compensation claims may not award attorney fees payable by any carrier or employer,” the draft says. Compensation judges would have power to approve such fee agreements “as consistent…

Report points to problems with AOBs, and a way around one proposed fix

in Statewide by

As the Legislature debates restricting attorney fees in insurance litigation involving assignment-of-benefits agreements, a tort-reform group has identified a way to circumvent that fix. Attorneys could convince policyholders to file suit in their own name. A report, “Restoring Balance in Insurance Litigation,” released Monday by the Florida Justice Reform Institute, discusses that possibility in the context of what it called abuse of “AOB” agreements, and of Florida’s one-way attorney fee statute. That law allows policyholders to sue insurers without the risk, should they…

in Statewide/Top Headlines by

Tallahassee Mayor Andrew Gillum continued his “Campaign to Defend Local Solutions” Friday, marshaling support from consumer, environmental, and anti-poverty organizations against proposed legislation that would block local business and professional regulations absent express permission from the Legislature. “We would like to work with our colleagues across the street in standing up for local democracy,” Gillum said during a news conference outside Tallahassee City Hall, which stands catacorner from the state Capitol. “It’s consistent with the governing party’s philosophy that decisions are best when…

House panel approves three measures tamping down on the judiciary

in Statewide by

A House committee voted Thursday to approve three proposals to tie the hands of Florida’s judiciary, including a proposed constitutional amendment to impose term limits on judges of courts of appeal and Supreme Court. Altogether, the measures would limit appellate judges to two six-year terms; remove a judicial education program from the Supreme Court’s supervision; and require the high court to report its caseload clearance rate to the governor and House and Senate leaders. Legislative leaders have chafed at court rulings striking down…

Jack Latvala says evidence doesn’t support House on job incentives

in Statewide by

The chairman of the Senate Appropriations Committee defended state spending on economic incentives Thursday by pointing to evidence the effort produces solid returns on investment. Visit Florida, for example, returns $3.20 cents for every dollar spent on advertising, according to figures (here; scroll down) from Amy Baker, state government’s top economist. Enterprise Florida’s international offices program, meanwhile, returns $4. And its export assistance program returns $1.90. That’s as measured in tax revenue. Not counting spending on beaches, transportation, and aviation,…
