Father of PBR Festivus Pole files residency complaint against Maria Sachs

“World-famous” political activist Chaz Stevens, when not getting ready another Festivus Pole for the Florida Capitol, is busy chasing state Sen. Maria Sachs over her increasingly nagging residency problem.

On Wednesday, the blogger and Editor in Chief of MAOS, a Boca Raton-based political website, filed a “formal complaint” with Sen. John Thrasher, who chairs the Senate Committee on Rules.

“I would (sic) to note that Senator Maria Sachs was recently reprimanded by a vote of the Senate for failing to disclose contributions to her affiliated political committee,” Stevens writes, “Additionally, the Ethics Committee found that she was sloppy in her required disclosure.

“Senator Sachs is exhibiting a pattern of willful disregard for the rules of the Florida Senate and the Florida Constitution, which she swore to uphold.”

In 2012, Republican Sen. Ellyn Bogdanoff lost to Maria Sachs for the newly redrawn Senate District 34, the only incumbent face off for a Senate race in the election cycle. Redistricting in 2010 resulted in two sitting Senators battling for re-election; Democrat Sachs won with almost 53 percent of the vote.

Maria Sachs claimed to live in Fort Lauderdale, at the condominium of her friend, political consultant Judy Stern, but then changed her voter registration to a Delray Beach condominium to keep with the current Senate rules.

In supporting his allegations, Stevens points out several provisions in the Florida Constitution, including one saying “the office of a state legislator has been viewed as being filled on Election Day, not at a later time such as when the results are certified or the oath of office is taken.”

To further his claim, Stevens provides “personal knowledge” – complete with photos and videos taken by a licensed private investigator, and available on MyActOfSedition.com — demonstrating that Sachs violated the state’s Joint Legislative Rule 7.1. His primary focus is on the legal determination of residence, which rests on the definition as “where one customarily resides.”

“Having seen the above described videos and reading the official statements of the Private Investigator Licensed by the State of Florida,” the letter continues, “it is my personal knowledge Senator Sachs stayed overnight at her husband’s house at 8185 Bridle Path, Boca Raton, FL on the night of January 29-30, 2014, (Wednesday Evening) and not at her declared residence of 1000 Lowry Street, Delray Beach, FL.”

Signing the letter “resident, Voter, and Father of the PBR Festivus Pole,” Stevens concludes by asking Thrasher’s Rules Committee to “fully investigate this matter, and where appropriate, apply the applicable sanctions.”
