Florida appeals court backs lawsuit over bank fee

A Florida appeals court Friday sided with a woman who filed a class-action lawsuit after being charged $5 to cash a check at a bank. Vida Baptista was charged a $5 fee when she went to a PNC Bank branch to cash a check that was drawn on a PNC account. She argues that the fee violated a law that requires banks to settle such checks at face value. An Orange County circuit judge ruled in favor of the bank, but the 5th District Court of Appeal on Friday reversed that decision, saying language in state law was “unambiguous.”
