Florida Institute for Neurologic Rehabilitation files new legal challenge

A Hardee County rehabilitation facility that serves people with head injuries has renewed a legal challenge against a state order to discharge 50 residents, according to documents filed in the Florida Division of Administrative Hearings.

The Florida Institute for Neurologic Rehabilitation contends that the state Department of Health used an invalid rule dealing with transitional living facilities to require the discharges. The challenge was sent to an administrative law judge Monday. The institute last month withdrew another administrative challenge because it said it did not have adequate time to prepare for a hearing. Inspectors from the Department of Health, the Department of Children and Families and the Agency for Health Care Administration went to the facility in August amid questions about the quality of care provided to residents. The state followed up by ordering the discharges.
