FIRST AND FOREMOST

Hearty happy birthday wishes from Michelle, Ella, and I to our friend, Senator Jack Latvala.  Save the late U.S. Rep. Bill Young, no one has done more during the last three decades for Pinellas County than Sen. Latvala. And few current lawmakers, if any, care more about the institution that is the Florida Senate than the senior statesman from Pinellas County.

IT’S ELECTION DAY IN AMERICA

It’s Election Day in America, and while no federal offices are at stake, there are plenty of local races and initiatives and state ballot measures worth looking at.

Here in Florida, Orlando Mayor Buddy Dyer goes up for reelection today. Two City Commission seats are also at stake.

The same holds true in Miami Beach, where Democratic incumbent Phillip Levine is on the ballot. There are also three open seats on the ballot.

In St. Petersburg, there are three city council seats up for grabs, but only one is truly competitive; The Lisa Wheeler-Brown and Will Newton district 7 contest. The results could have a direct impact on whether the can go back to an original plan that Mayor Rick Kriseman proposed last year that would all the Tampa Bay Rays the right to speak to officials in neighboring Hillsborough County about possibly relocating there.

Nationally, here are some of the more interesting issues that Americans will vote on:

In Ohio, Issue 3 would allow adults over 21 years old to buy and carry up to an ounce of marijuana and, if they got a permit (likened to a fishing license in voter-education materials), to grow up to eight ounces of weed for personal use.

In Colorado, where pot has been legal for years, there’s Proposition BB, which would allow the state to keep all pot tax revenue rather than refund it to taxpayers as required by the state’s taxpayer bill of rights.

In Kentucky, Republicans have held the governor’s mansion in Frankfort for just four years of the past 44. But the GOP dominates the conservative Bluegrass State’s congressional delegation, and would be favored to win in a cakewalk had it not nominated a Tea Party-styled insurgent, Matt Bevin, whose primary political experience is getting clobbered by Republican leader Mitch McConnell in last year’s U.S. Senate primary. Bevin narrowly trails Democrat Jack Conway, Kentucky’s former Secretary of State, in what is projected to be a low-turnout off-year election.

In Maine, Question 1 would provide more money to the state’s elections public funding account by eliminating $6 million in corporate tax breaks.

In Mississippi, a citizen-sponsored constitutional amendment will be on the ballot. Initiative 42 would transfer some of the power to appropriate funds for the state’s public schools from the legislature to judges.

In Texas, Prop 1 would increase the residential homestead property tax exemption from $15,000 to $25,000.

And in Washington, voters will decide whether or not to reduce the state sales tax from 6.5% to 5.5%.

And in San Francisco there is Proposition F, where more than $8 million has been raised by Airbnb and its supporters to fight tougher restrictions on short-term “vacation rentals.” Specifically, it would impose  restrictions on private, short-term housing rentals, often referred to a “vacation rentals.” It would restrict all such private rentals to only 75 nights per year and impose provisions designed to ensure that such private rentals are paying 14% hotel tax and following all city codes. It would also require detailed guest and revenue reports from rental hosts and “hosting platforms,” such as Airbnb.

BEN CARSON VAULTS TO LEAD IN LATEST WSJ/NBC POLL via Patrick O’Connor of the Wall Street Journal – The result marks the first time since June that the Journal/NBC News poll has found a Republican other than Donald Trump to be leading the GOP field. Some 29% of GOP primary voters rank Ben Carson as their top choice, while 23% favor Trump. Marco Rubio and Texas Sen. Ted Cruz rank third and fourth as the top pick of 11% and 10% of Republican primary voters, respectively. Some 8% prefer eb Bush. No other Republican garners more than 3% support.

LATEST FLA. POLL: TRUMP IS CLEAR FRONTRUNNER — WITH BUSH’S HELP via Marc Caputo of POLITICO Florida  Trump leads with a solid 27% support, with Rubio a distant second at 16%, followed by  Carson (15%), and Cruz and Bush (about 12% each), according to Viewpoint Florida’s newly released survey of 2,047 likely Republican voters in the state.

MORE POLLING: A new Monmouth poll in New Hampshire finds Trump leading the GOP presidential race with 26%, followed by Carson at 16%, Rubio at 13%, Kasich at 11%, Cruz at 9%, Bush at 7%, Carly Fiorina at 5% and Chris Christie at 5%.

BUSH HITS CAMPAIGN RESET, RETOOLS SLOGAN: ‘JEB CAN FIX IT’ via Thomas Beaumont  and Tamara Lush of the Associated Press – Bush launched the make-over on Monday at a long-planned campaign rally in friendly, home-state Florida, a reset to an underwhelming campaign for the Republican nomination. Principles and accomplishments — not style and flash — anchor the campaign, he told supporters. That would account for Bush’s choice to use a can-do slogan that could apply as much to Bush’s effort to steady his campaign as it does to his sense of confidence about handling the nation’s problems.

“This election is not about a set of personalities. It’s about a set of principles,” Bush said, in a jab at rivals Trump and Rubio, and a nod to his flat performance in the debate last week in Colorado. As the audience at the Tampa Garden Club applauded, he added, “It is about leadership.”

… But surrounded Monday by friends and former colleagues, Bush delivered a speech in Tampa that amounted to re-declaring his candidacy, without changing his message or significantly altering his campaign strategy. Bush recently announced an across-the-board cut in salaries to protect his available campaign cash for the final charge into Iowa.

Kicking off this leg of his campaign in Florida, surrounded by former statehouse colleagues and supporters made sense strategically, said Todd Josko, a 47-year-old communications consultant from Tampa. But it especially made for a warm reception for Bush facing a time of trial, Josko said.

“Home cooking cures all ills,” Josko said, adding that people will look back on Monday, “as the day the campaign turned around.”

RICHARD CORCORAN TOURS WITH BUSH, SAYS HE CALLED MARCO RUBIO via Kristen Clark of the Miami Herald – Corcoran, who was Rubio’s legislative chief of staff, had previously not taken sides in the presidential race, but on Monday, he declared Bush “without question, the most courageous conservative in this race.” … When asked by the … whether he’d spoken to Rubio about his endorsement of Bush, Corcoran initially hesitated to answer, calling it “personal.” “No, I have,” he then said. “Of course, I have. Marco’s a friend. Of course, I’d give him that dignity. I explained to him, as he knows full well, that I have tremendous respect for Marco … It’s nothing against Marco Rubio, nothing at all.”

BUSH TAPS NEW CHIEF OPERATING OFFICER AFTER SHAKEUP via Alex Isenstadt of POLITICO – Bush has tapped Janan Grissom as … new chief operating officer … Grissom has long ties to the Bush family, having served as director of administration in George W. Bush’s reelection campaign. She also served as White House liaison for the U.S. Department of Treasury.

SHOT – IOWANS REMAIN OPEN TO BUSH’S CAMPAIGN via Brianne Pfannenstiel of the Des Moines Register – Experts say voters still settling on choices with 3 months until caucuses … Tim Hagle, a political science professor at the University of Iowa, … said the number of precinct captains … (129 in Iowa’s more than 1,700 precincts) causes some concern.

It was up to those on the call, he said, to help pitch in while he was busy on the campaign trail.

RUBIO WINS FIRST ENDORSEMENT FROM FELLOW U.S. SENATOR via Mitch Perry of Florida Politics – Colorado Republican Cory Gardner … became the first U.S. senator to endorse … Rubio‘s presidential candidacy … “Our country needs a new generation of leadership, and I believe that Marco Rubio presents this nation with the greatest possibilities and opportunities to meet the challenges of the next generation.”

RICK HARRISON OF ‘PAWN STARS’ SAYS HIS BUSINESS IS SUFFERING FOR SUPPORTING RUBIO via Philip DeVoe of The DC – “I suddenly became famous and I was the one willing to throw my career away to endorse a Republican. When you endorse a Republican, everyone sort of frowns on you. I don’t know why, but hey,” Harrison said in an interview with CNN … asked if he has felt any backlash … “To a degree, yeah. There have been some endorsements that didn’t happen.”

‘LIGHTWEIGHT,’ ‘SWEATY,’ ‘OVERRATED’: TRUMP’S CHOICE WORDS ABOUT  RUBIO via Patricia Mazzei of the Miami Herald – Trump bashed Rubio again… giving his trademark characterization of the Florida senator. “I think he’s highly overrated. I think he’s an overrated person. I don’t think he’s going to make it,” Trump began. He only took off from there, repeating his criticism that Rubio is a “lightweight” and “sweaty,” and opining that the 44-year-old Rubio is “less attractive” than himself. Last time Trump ripped Rubio, Rubio responded by calling Trump “insecure.”

FIRST ON FLORIDA POLITICS – HERNANDO CONGRESSMAN RICHARD NUGENT WON’T SEEK RE-ELECTION IN 2016 via Read here — Nugent, the former Hernando County sheriff who since 2010 has represented Florida’s 11th Congressional District, will not seek re-election … “It is with decidedly mixed emotions that I am announcing today that I will not be seeking another term in Congress” … [his] decision creates an open seat non-opportunity Republicans are expected to easily win. “Although it is immensely frustrating at times, serving in Congress can also be a remarkably fulfilling endeavor.”

JUSTIN GRABELLE QUICKLY DECLARES FOR HIS BOSS’S SEAT IN CONGRESS via Kevin Derby of the Sunshine State News – Hours after he announced that he would not seek a fourth term in Congress … Nugent … threw his support behind his former chief of staff Justin Grabelle to replace him. Before working for Nugent, Grabelle was an aide to U.S. Rep. Ginny Brown-Waite … including serving as her chief of staff. “Justin has been a close and trusted advisor for me during my time in Congress, and it’s because he shares my view on what it means to be a public servant,” Nugent said. “Justin believes that if you are willing to sacrifice, to lead from the front, to make the tough decisions and be honest with people, there is nothing you can’t accomplish.”

FLORIDA HOUSE MOVES AHEAD WITH ITS OWN MAP via Gary Fineout of the Associated Press – The House is moving ahead with its own map for the state’s 40 Senate districts. A House committee on Monday voted along party lines for a map that is different from one approved by the full Senate.

Despite the differences, Rep. Jose Oliva maintained that the House and Senate are not on a “collision course.” Oliva is the House Republican in charge of redistricting.

QUESTIONS EMERGE ABOUT CHANGES BEHIND HOUSE MAP; JACK LATVALA SEES REVENGE via Mary Ellen Klas of the Miami Herald – In the House’s proposed Senate District 1, now held by Greg Evers … hometown of Baker is removed from his district … Evers was among a handful of Republicans who voted against the Senate map … [and] is a supporter of  … Jack Latvala … [who faces] Joe Negron for the Senate presidency, whom House leaders quietly prefer. Latvala sees revenge in the House’s actions.  “There is no doubt in my mind they are not happy with me because I spoke my mind about the process and because they don’t want me to be Senate president … This is being done by the same people who talked about rejecting the Senate changes to the congressional map because it wasn’t the base map. Here, they have made changes for some very shaky reasons.”

CHALLENGERS SUBMIT TWO NEW SENATE PLANS via Mary Ellen Klas of the Miami Herald – The coalition of voter groups led by the League of Women Voters and Common Cause of Florida “is concerned that the Legislature’s proposals continue to reflect constitutional infirmities and evidently fail to take into account ongoing developments in minority voting in certain communities,” wrote David King, lead attorney for the groups that have challenged the Legislature’s redistricting maps. He urged lawmakers to update its redistricting data, start over, and consider the plaintiffs’ maps. … The two proposals, CP-2 and CP-3, provide two alternatives to the minority majority seats before both the House and Senate. One creates a Hillsborough-only African American minority seat that doesn’t cross Tampa Bay. The other creates a fourth Hispanic seat in South Florida.

When your results add up to more than 100%, you have a problem.

FDLE “CAN’T KEEP UP” WITH OFFICER-INVOLVED SHOOTING CASELOAD, REQUESTS $3.4M FOR NEW AGENTS via WFTS – Florida Department of Law Enforcement’s … caseload on officer-involved shootings jumped 31 percent last year; and rising 117 percent during the past five years. The backlog is leaving the FDLE “overwhelmed” … “We anticipate the requests for FDLE to investigate officer involved shootings to continue to increase,” FDLE representative Gretl Plessinger … For 2016, the FDLE is asking the state for nearly $3.4 million to hire 26 agents, as part of a program to address a critical issue. If the request does not make this year’s budget, officials warn the problem could spread and further delay other important crime investigations.

RICK SCOTT MEETS OFF-THE-GRID WITH INSURANCE REGULATOR KEVIN MCCARTY via Florida Politics – Scott huddled with embattled insurance commissioner … McCarty … after a meeting of the Florida Cabinet … The off-the-grid meeting is only serving to fuel speculation that McCarty will soon leave the Office of Insurance Regulation, despite his public statements to the contrary … spokesperson at the Office of Insurance Regulation says the meeting was scheduled. However, the meeting does not appear on the governor’s official schedule.

MATT GAETZ FILES UBER PREEMPTION BILL via Mitch Perry of Florida Politics – Gaetz has filed legislation in the Florida House (HB 509) that would put ensure that Transportation Network Companies (TNC) such as Uber and Lyft aren’t regulated like taxi companies … would require any representative for a TNC to obtain a permit from the state of Florida and pay an annual fee of $5,000 … It would also preempt any local government from attempting to regulate such companies.

FAR-REACHING HIGH SCHOOL ATHLETICS BILL FILED IN SENATE via Jim Rosica of Florida Politics – Two Republican state senators have filed omnibus education legislation that … would ease eligibility requirements to play in high school athletics … Don Gaetz … and Kelli Stargel … filed the 25-page bill (SB 684) … [That] would “allow a student to be immediately eligible (to play sports) in the school in which he or she first enrolls each school year,” without having to wait for the approval of a school board … a school district can’t “delay eligibility or otherwise prevent a student” who exercises school choice “from being immediately eligible to participate in interscholastic and intrascholastic extracurricular activities,” including athletics.

AUDITING PANEL MUSES WHETHER LOBBYISTS SHOULD BE AUDITED via Jim Rosica of Florida Politics – A panel of state lawmakers going over the first-ever audits of lobbying firm income … started bringing up a common question: Why are we doing this? “I may be an outlier … (but) I don’t understand how the public’s interest is advanced by this exercise,” said state Sen. Rob Bradley … who sits on the Joint Legislative Auditing Committee. “I just don’t see how this information is relevant” … other than being a “marketing tool for big lobbying firms.” Committee Chair Dan Raulerson … could be heard telling him, “I’m with you on this.”

BILL FILED TO CREATE FLORIDA HOLOCAUST MEMORIAL via Florida Politics – Jared Moskowitz filed a bill … to create a Florida Holocaust Memorial at the state Capitol in Tallahassee … HB 513 would direct the Department of Management Services to receive recommendations from the Florida Historical Commission on where and how within the Capitol complex to build a memorial to the millions of victims of Nazi extermination and labor camps. Moskowitz says the time to build a statehouse memorial is now … “Soon, will have no live witnesses.”

DEVAUGHN DARLING CLAIM BILL FILED AGAIN via Jim Rosica of Florida Politics – Lawmakers have filed … a “claim bill” to compensate the family of Devaughn Darling, a Florida State University freshman linebacker who died during a February 2001 practice. State Rep. Mia Jones … submitted the bill (HB 3513) … Senate companion sponsored by Democratic Leader Arthenia Joyner … The Darling family filed a wrongful death lawsuit against the university, which they settled for $2 million in 2004.

LEGISLATIVE COMMITTEE MEETING AGENDAS via Legislative IQ powered by Lobby Tools

HOUSE COMMITTEE CONSIDERS SCHOOL BOARD FLEXIBILITY 

The House K-12 Subcommittee will be taking up legislation that gives school boards more flexibility over certain building codes. They will also consider a pilot program giving principals more financial authority. Meeting begins 9 a.m. in Room 17 of the House building.

PRESENTATION ON LOW INCOME POOL FUNDING

The Agency for Health Care Administration will give a presentation to the House Health Care Appropriations Subcommittee updating the status of federal Low Income Pool funds. Meeting begins at noonin Room 212 of the Knott Building.

HOUSE HEARING ON HYDRAULIC FRACKING 

The House Agriculture and Natural Resources Subcommittee will discuss several bills regulating hydraulic fracking in Florida. Meeting is from noon to 2 p.m. in Room 102 of the House building.

SENATE APPROPRIATIONS LOOKS AT EDUCATION BUDGET 

The Senate Appropriations Subcommittee on Education will talk 2016-2017 budget without taking a vote. Meeting is 1 p.m. in Room 412 of the Knott Building.

SENATE HEARS PRESENTATION ON ECONOMIC INCENTIVES 

The Senate Transportation, Tourism and Economic Development Appropriations Subcommittee will hear presentation on economic incentives proposed by Gov. Scott. Scott is asking lawmakers for $250 million in business incentives for 2016. Meeting begins 2 p.m. in Room 301 of the Senate Office Building.

JACK LATVALA RAISES MORE THAN $172K IN FIRST 19 DAYS OF RE-ELECTION CAMPAIGN via Florida Politics – Latvala’s campaign has pulled in $172,752 in the first 19 days it was in operation, and only spent $6,090, leaving his campaign account with $166,662 cash on-hand … was set to term out of his seat in 2018, but confusion over how the Florida Senate maps will shake out – and the high probability that he will be pushed into a different district – led the Florida Division of Elections to allow the 14-year Senate veteran to file to run for office one more time.

JOE DAVIDOW OFFICIALLY KICKS OFF CAMPAIGN FOR HD 80 via Florida Politics – Davidow officially kicked off his campaign for House District 80 with an event on Hodges College campus … told a crowd of around 70 people that he was “deeply concerned” about the “large influx of new residents” to the state and how it may affect Florida families … “I want my daughters to grow up in a State that provides a quality education, maintains the environment that we all came here for and has excellent job opportunities available so they don’t have to leave to seek gainful employment” … has built up about $13,000 in on-hand money through his first four months in the race.

CORRECTION: Yesterday’s Sunburn listed Jeremy Wallace as with the Sarasota Herald-Tribune. He led that paper earlier this year for the Tampa Bay Times.
