A Tallahassee judge has tossed out a lawsuit over the use of “Wite Out” on state Rep. Dan Raulerson‘s re-election filing paperwork. In an order issued Wednesday, Circuit Judge Charles W. Dodson dropped the case brought by Jose N. Vazquez Figueroa, the Democrat who unsuccessfully challenged Raulerson last year for the House District 58 seat. Dodson ruled he did not have jurisdiction to decide the matter and threw out the suit “with prejudice,” meaning Vazquez can’t refile it. Raulerson’s lawyer, Emmett Mitchell, had argued in a Tuesday court hearing that the judge couldn’t…

A Tallahassee judge now will decide whether a lawsuit challenging state Rep. Dan Raulerson‘s re-election over the use of “Wite Out” will go forward. “I’m going to review this and get an order out,” Circuit Judge Charles W. Dodson said Tuesday, after a half-hour hearing. “Good luck.” Raulerson’s attorney had moved to toss out the case, saying it was moot with the Plant City Republican having won in November and been sworn in to represent House District 58.  Only the House of Representatives, which is constitutionally the sole…

Jose N. Vazquez Figueroa blames “mental fatigue” for his missing a hearing in his own lawsuit challenging state Rep. Dan Raulerson‘s re-election this year. Vazquez may have even more on his mind: The Florida Elections Commission now is suing him for unpaid fines levied for campaign finance reporting irregularities from his unsuccessful 2014 campaign. “Something’s wrong in Tallahassee,” he said in a Monday morning phone interview. “I don’t know whether they have something against candidates of the Democratic party or something against Hispanics…

It’s always a bad sign when a plaintiff doesn’t show up for a hearing in his own lawsuit. Jose N. Vazquez Figueroa was supposed to be in the Leon County Courthouse Wednesday morning to explain why he should win his suit against state Rep. Dan Raulerson. Vazquez, who is representing himself, is seeking to disqualify Raulerson, a Plant City Republican, from his re-election this year to his House District 58 seat. Vazquez was his unsuccessful Democratic opponent. His suit says…

No action taken in Dan Raulerson ‘Wite-Out’ case

in The Bay and the 'Burg/Top Headlines by

It’s always a bad sign when a judge says he’s “not sure what we’re supposed to be doing.” Leon County Circuit Judge Charles W. Dodson took no action Tuesday in a hearing on a case seeking to disqualify state Rep. Dan Raulerson from running for re-election to his House District 58 seat. His Democratic opponent, Jose N. Vazquez Figueroa, sued because Raulerson’s notary had incorrectly used “correction fluid” on his filing paperwork. But Vazquez, who is representing himself, didn’t make clear the purpose for Tuesday’s…
