Thursday, the Florida Senate unanimously passed legislation sponsored by freshman Senator Wilton Simpson to crack down on utility theft with varying penalties based on the extent and value of electricity stolen.
Currently, energy theft is a misdemeanor regardless of the dollar value of the electricity stolen. Under SB 338 the offense degree and penalties will depend on the value of the property or service stolen as well as other factors such as whether the theft is a first offense. The bill also increases the civil penalty for a person found to have violated the statute on utility theft.
“Electricity theft is a growing problem for Florida’s utilities. We need stronger laws to deter electricity theft and to help utilities minimize losses due to theft that currently must be recovered through increased rates,” said Senator Simpson.”This legislation will go a long way in protecting consumers from rate hikes.”
