Split appeal court upholds Rick Scott’s 2015 veto of firefighters’ $2,000 raise

in Statewide by

The governor’s constitutional authority to veto budget line items trumps a state law requiring him to bow to the Legislature when it resolves labor collective bargaining impasses, a divided 1st District Court of Appeals ruled Tuesday. The majority conceded that, under the state Labor Code, “any actions taken by the Legislature shall bind the parties” — meaning a public employee union and the governor. “Based primarily on a statute, appellant asks us to recognize a limitation on the governor’s constitutional…

New deal? Gretna asks court to reconsider slots ruling

in Statewide/Top Headlines by

Lawyers for a North Florida racetrack have asked the state’s Supreme Court to rehear argument in a case over whether pari-mutuels can add slot machines in counties that passed referendums allowing them. Gretna Racing‘s motion for rehearing was filed late Friday, court dockets show. The horse track, also known as Creek Entertainment/Gretna, is managed and operated by the Poarch Band of Creek Indians. Last month, the court unanimously ruled against the track, meaning that gambling facilities in Gadsden County’s Gretna and in…

Florence Snyder: A Valentine to Judge Carithers — thank you for being embarrassed

in Statewide/Top Headlines by

An unvarnished, unqualified apology is hard to find these days, so let’s take a moment to thank Duval County Circuit Judge Hugh Carithers for reminding us what it looks like. Last month, the 1st District Court of Appeal repealed an unfortunate order of a Jacksonville-based hearing officer, and replaced it with a reminder that hearing officers do not have the authority to put people in jail for failing to pay child support. When the Jacksonville Times-Union came calling for the…

Legal briefs due soon in Florida Lottery appeal

in Apolitical/Top Headlines by

Initial briefs are due early next month in the Florida Lottery’s appeal of a Tallahassee judge’s decision that invalidated its $700 million contract for new equipment. Circuit Judge Karen Gievers in March had invalidated the Lottery’s arrangement with IGT (International Game Technology), agreeing with House Speaker Richard Corcoran that the agency went on an illegal spending spree when it inked the deal last year. Corcoran had filed a “writ of quo warranto,” a court action against government officials to demand they…

Florida Supreme Court rules against Gretna track, slots expansion

in Statewide/Top Headlines by

A unanimous Florida Supreme Court has ruled against a North Florida racetrack seeking to add slot machines. The 20-page decision, released Thursday, means that gambling facilities in Gadsden County’s Gretna and in seven other counties that passed local referendums allowing slots also will not be able to offer them. In doing so, the court upheld a decision by the 1st District Court of Appeal that agreed with state gambling regulators who denied the track a slots permit. In sum, the…

Supreme Court OKs taxing satellite TV higher than cable

Satellite TV

Satellite-television service can be taxed at a higher rate than cable TV, the Florida Supreme Court decided Thursday. Satellite companies had challenged the state’s 16-year-old Communications Services Tax (CST), which now taxes cable service at 4.92 percent and satellite at 9.07 percent. Those concerns, led by DirecTV, said that difference was unconstitutional and asked for a refund. But the high court reversed the 1st District Court of Appeal’s 2-1 decision, which said that taxing the two services differently is unconstitutional. Then-1st DCA Judge Simone Marstiller, in her…

Court ruling could result in explosion of gambling permits

in Apolitical/Top Headlines by

An appellate court’s ruling promises to further muddy the legal landscape of gambling in Florida. A 1st District Court of Appeal opinion released Tuesday reversed the Department of Business and Professional Regulation and ordered the reinstatement of a South Florida casino’s application for a new “summer jai alai” permit. The department regulates gambling. Pari-mutuels, particularly in Broward and Miami-Dade counties, covet such permits because at a minimum they allow a facility to open a cardroom and offer simulcast betting. The decision promises to result…
