Insurance Council counters challenge to big workers’ comp rate hike

in Statewide/Top Headlines by

An insurance industry council moved Monday to block a legal challenge to proposed workers’ compensation premium increases of nearly 20 percent, warning that delay would threaten the solvency of Florida’s system for compensating injured workers. The state Office of Insurance Regulation is scheduled to take up the rate hike Tuesday morning in Tallahassee. Delay, the National Council on Compensation Insurance warned, “could cause severe public harm, as workers’ compensation rates are currently not adequate to meet claims.” The group said…

An injured South Florida nurse who unsuccessfully challenged the state’s workers’ compensation system now wants the U.S. Supreme Court to take up the case. Florida Supreme Court strikes down another part of worker’s comp law

in Statewide/Top Headlines by

The state’s Supreme Court on Thursday delivered another blow to Florida’s workers’ compensation law. In a 5-2 decision, the court ruled unconstitutional part of the law that “cuts off disability benefits … to a worker who is totally disabled and incapable of working but who has not yet reached maximum medical improvement,” or in other words, the person cannot heal any further. That cutoff “is unconstitutional … as a denial of the right of access to courts,” said the opinion by Justice Barbara Pariente. That’s because “it deprives an injured worker…

The National Federation of Independent Business/Florida is adding its voice to the business groups decrying a proposed 17 percent hike in the cost of workers’ compensation insurance to employers. The rate increase “is a $623 million tax on workers in Florida that will go primarily to workers’ compensation attorneys,” NFIB/Florida Executive Director Bill Herrle said in a statement. “For the sake of Florida’s small businesses and the millions they employ, this cannot stand,” he added. “The filing is the tip of the…

Business lobby blasts workers’ comp rate hike

in Statewide/Top Headlines by

The state’s business groups are saying “we told you so” over the cost of workers’ compensation insurance. The National Council on Compensation Insurance (NCCI) has asked the state to consider a 17 percent rate hike in the cost of workers’ comp to employers. Workers’ comp is mandated by states to pay workers who get hurt on the job. The council submitted its filing to the Office of Insurance Regulation on Friday. If approved, it would take effect Aug. 1. That would collectively cost Florida businesses roughly $623 million and make the Sunshine…
