Paul M. Anderson: Stereotypes won’t help Florida workers – or produce real reform

in Statewide/Top Headlines by

As the chair-elect of the Workers’ Compensation Section of the Florida Bar, I believe it is important to correct misconceptions and misstatements made by the head of the Florida Chamber regarding Florida’s workers’ compensation system and the attorneys who represent injured Floridians. In a recent column, Mark Wilson and the Chamber suggest the workers’ compensation rate increase approved by Florida’s new Insurance Commissioner benefits only “billboard trial lawyers.” Nothing could be further from the truth. The commissioner approved a ridiculous…

State issues final order for workers’ comp cost increase

in Statewide by

As expected, state insurance regulators have issued a final order jacking up the price of worker’s compensation insurance by nearly 15 percent. The order was published Thursday. The decision approves the National Council on Compensation Insurance (NCCI) request “for an overall combined statewide average rate increase of 14.5 percent,” the Office of Insurance Regulation said in a press release. The rate hike, which applies to new and renewal policies, is effective Dec. 1. The increase continues to be bitterly opposed by business groups. The…

Bill Herrle: Worker’s comp hike hurts small biz

in Statewide by

NFIB/Florida Executive Director Bill Herrle on Wednesday criticized workers’ compensation insurers for pushing through a 14.5 percent rate increase this month. Herrle called the increase “massive” and said it would “undoubtedly hurt small businesses by threatening their ability to keep their doors open and employ Floridians.” The National Federation of Independent Business calls itself “the nation’s leading small-business advocacy group,” according to its website. State regulators approved a 14.5 percent increase in workers’ compensation insurance premiums. The new rates, however, are lower than ones initially proposed by…

Florida business up in arms about 14.5 percent workers comp rate hike

in Statewide/Top Headlines by

Florida employers knew a significant increase in workers’ compensation premiums was coming. That didn’t soften the blow that landed Tuesday, when the Florida Office of Insurance Regulation approved a 14.5 percent average premium hike on new and renewal policies, effective Dec. 1. “Since the decision by the Florida Supreme Court on the Castellanos case to return to hourly rate attorneys fees, we knew it was only a matter of time before a significant workers’ compensation rate increase was approved, ultimately…

Regulators approve 14.5 percent workers compensation premium hike

in Statewide/Top Headlines by

State regulators Tuesday approved a 14.5 percent average increase in workers’ compensation insurance premiums — less than the 19.6 percent hike sought by an industry council. The new rates take effect Dec. 1. The original rate proposal by the National Council on Compensation Insurance, or NCCI, would have taken effect on Oct. 1. The higher rates apply to new and renewed policies but not to existing coverage, the Florida Office of Insurance Regulation said. NCCI proposed new rates in May…

Decision near on proposed workers compensation insurance rate hike

in Statewide by

Florida’s business owners will soon find out the fate of a proposed increase of nearly 20 percent in workers compensation insurance rates. “We’re getting very close to being finished with those review and putting these rate filings out into the public, so our business owners and community can respond to that and plan effectively,” state Insurance Commissioner David Altmaier told Gov. Rick Scott and the Florida Cabinet Tuesday. The Florida Office of Insurance Regulation held a public hearing in August on…

Open government activists back legal challenge to worker’s comp rate increase

in Statewide/Top Headlines by

A leading open-government advocate offered strong support Monday for a legal challenge to a proposed workers’ compensation insurance premium increase of nearly 20 percent. “I think he’s got a cause of action,” First Amendment Foundation President Barbara Peterson said of Miami attorney James Fee, who is challenging the rate hike on open-government grounds. Fee filed suit in Miami-Dade Circuit Court last week alleging that the National Council on Compensation Insurance broke state open meetings and open-records laws when calculating its…
